Public Notice - Alternative Approval Process

This is the second of two notices to advise electors in Electoral Areas G, H and L of the Cariboo Regional District’s intention to adopt South Cariboo Cemeteries Contribution Establishment Bylaw No. 5071, 2017.

SYNOPSIS OF BYLAW NO. 5071

The following is a synopsis of Bylaw No. 5071 and is not intended as an interpretation of it. The bylaw, in its entirety, is available for inspection at the Cariboo Regional District office in 100 Mile House during regular office hours from June 22, 2017 through July 31, 2017, and on the Cariboo Regional District’s website.
 
If adopted, Bylaw No. 5071 will provide a contribution of funds toward the operation of established, registered cemeteries in the south Cariboo including in the District of 100 Mile House. The total annual property taxes for this service shall not exceed the greater of $15,000 or an amount raised by applying an overall tax rate of $0.007/$1,000 to the net taxable value of land and improvements in the service area. It is estimated that this would result in a tax increase for the average residential property of $0.59 per $100,000 of net taxable assessment of land and improvements, per year. The service area would be all of Electoral Areas G, H and L.
 
The Cariboo Regional District (CRD) intends to adopt South Cariboo Cemeteries Contribution Establishment Bylaw No. 5071, 2017 unless, by 4:00 p.m. on July 31, 2017, at least 10 percent of the electors in Electoral Areas G, H and L sign an elector response form opposing the adoption of the bylaw without a vote being held.
 
The number of elector responses required to prevent the CRD from proceeding without a referendum is estimated to be 866. A report respecting the basis on which this determination was made is available upon request from the CRD.
 

Elector responses are required to be submitted to the Cariboo Regional District on a form that can be obtained during regular business hours from the Cariboo Regional District offices. The form can also be downloaded from the CRD’s website at cariboord.ca. The only elector response form that will be accepted is the one provided by the Cariboo Regional District, or an accurate copy of it.

Only electors of Electoral Areas G, H and L of the Cariboo Regional District are eligible to sign the elector response forms. There are two types of electors – resident electors and non-resident property electors.

Resident Elector: When signing an elector response form during an AAP, a resident elector must: be 18 years of age or older; be a Canadian citizen; have lived in British Columbia for at least the last six months; have lived in Electoral Area G, H or L for at least the last 30 days; and not be disqualified under the Local Government Act, or any other enactment from voting in a local election, or be otherwise disqualified by law.

Non-resident Property Elector: When signing an elector response form during an AAP, a non-resident property elector must: be at least 18 years of age; be a Canadian citizen; have lived in British Columbia for at least the last six months; have owned property in Electoral Area G, H or L for at least the last 30 days; and not be disqualified under the Local Government Act or any other enactment from voting in a local election, or be otherwise disqualified by law.

Note: Only one non-resident property elector may sign an elector response form per property, regardless of how many people own the property; and, that owner must have the written consent of a majority of the other property owners to sign the response form on their behalf. Properties owned in whole or in part by a corporation do not qualify.

Resident electors signing the elector response form must provide their name and address.

Non-resident property electors must provide their name and the address of the property in relation to which they are entitled to register as a non-resident property elector. The Cariboo Regional District will not share the information on the form with anyone other than its Corporate Officer or other persons designated by the Corporate Officer.

Elector Response Forms, to be valid, must be received by the undersigned, in the form established, no later than 4:00 p.m. on Monday, July 31, 2017 and must only be signed by duly qualified electors within Cariboo Regional District Electoral Areas G, H and L.
